Results Not Yet Released to Public
The state-sanctioned independent civil investigation into the deadly Kaloko Dam collapse on Kauai is finished. The investigation documents activity leading to the breach of the Kaloko reservoir, but the investigation’s conclusions are a mystery, at least for now.
Kaloko burst March 14, 2006. An estimated 400 million gallons of water rushed downslope cutting a path of destruction all the way to the ocean. Buildings were wiped out and seven people were killed. Families of the deceased have filed a wrongful death suit against several defendants including retired car dealer James Pflueger who owns the reservoir.
“What we alleged in the complaint was in the late 90s, there was a covering of the spillway by Pflueger and the entities that were involved in the ownership and that that led to the failure of the dam,” said Rick Fried, an attorney who represents the plaintiffs in the case.
Pflueger’s attorney, Bill McCorriston, has said there is no relation between the spillway and the breach and his client is not responsible for what happened.
